These Terms of Service ("Terms") govern your use of the OpenDesign mobile application ("App") provided by Ryan Joshua Fermoselle ("we," "us," or "our").
By downloading or using OpenDesign, you agree to these Terms. If you do not agree, do not use the App.
Our Privacy Policy describes how we handle information and is incorporated by reference where applicable.
You must be at least 13 years old to use the App. If you are under 18, you may use the App only with permission from a parent or legal guardian who accepts these Terms on your behalf.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, subject to these Terms and Apple's App Store rules.
You may not:
You retain ownership of content you create, import, scan, record, or export in the App ("User Content").
You are solely responsible for User Content and for ensuring you have the rights to use, share, export, stream, or publish it. Do not upload or share content that infringes others' rights or violates law.
You grant us only the limited rights needed to operate the App on your device and to process actions you request (such as exporting a file or connecting to a printer you choose).
Some features require an active OpenDesign Pro subscription.
Refunds are handled by Apple under Apple Media Services Terms and Conditions.
Without a Pro subscription, certain features and project limits may apply. We may change free-tier limits or features with reasonable notice where required.
The App may interact with third-party services, including:
Your use of third-party services is governed by their own terms and privacy policies. We are not responsible for third-party services.
OpenDesign includes tools for design, engineering, architecture, chemistry, electronics, and related fields. Outputs are for creative, educational, and prototyping purposes unless you independently verify them.
We do not guarantee that:
You are solely responsible for professional review, testing, compliance, and safety before real-world use.
Some features use the camera, LiDAR, or ARKit face and body tracking for scanning, animation, and avatar control. These features process data on your device in real time. You are responsible for obtaining consent from people who appear in scans, recordings, streams, or avatars.
Features that connect to local printers, stream video/audio, or join nearby multiplayer sessions operate on your network or with nearby devices. You are responsible for securing your network credentials, stream keys, and shared sessions.

The App, branding, UI, and underlying software are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you ownership of the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or secure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP OR SUBSCRIPTIONS IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold us harmless from claims arising out of your User Content, your use of the App, or your violation of these Terms or applicable law.
You may stop using the App at any time by deleting it. We may terminate or suspend your access if you violate these Terms or if required for legal or security reasons.
Sections that by nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and indemnity.
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country require otherwise.
We may update these Terms from time to time. Continued use after the updated Terms are posted constitutes acceptance.
